RCinéDrone
1. Definitions
RCinéDrone: a Quebec-based company specializing in aerial cinematography and drone services.
Client: any individual or business that has entered into an agreement with RCinéDrone.
Consumer: a natural person acting for personal purposes.
Parties: RCinéDrone and the client.
2. Application of the Terms
These terms apply to all estimates, offers, activities, orders, agreements, and deliveries of services or products carried out by RCinéDrone. Any modification must be agreed upon in writing. The client’s own general terms and conditions do not apply, unless expressly approved in writing.
3. Offers, Estimates, and Acceptance
Estimates are valid for 30 days unless otherwise specified. They are non-binding until accepted in writing. Any changes requested after acceptance may result in a price adjustment.
4. Pricing
Prices are expressed in Canadian dollars (CAD), before taxes. They may include additional fees (travel, permits, insurance). The estimated price may vary depending on the actual conditions of the shoot.
5. Payment Terms
Payment is due within 30 days. RCinéDrone may suspend its services in the event of non-payment.
6. Insurance
The client is responsible for insuring their own property and premises.
7. Client Obligations
Provide all necessary information. Ensure the accuracy of the data supplied. Provide safe access to the locations.
8. Performance of the Mandate
RCinéDrone undertakes to provide its services in accordance with industry standards. It is bound by an obligation of means, not an obligation of result.
9. Weather Conditions
Flights may be postponed in the event of unfavorable weather conditions. A no-fee rescheduling option will be offered.
10. Claims
Claims must be submitted within a reasonable timeframe. RCinéDrone will correct any deficiency attributable to its own actions.
11. Limitation of Liability
RCinéDrone is not liable for indirect damages. Maximum liability: the amount of the invoice for the service concerned.
12. Cancellation
Less than 48 hours: 25% of the total amount.
Less than 24 hours: 50% of the total amount.
Technical cancellations (NAV Canada, weather): incurred costs will be billed.
13. Force Majeure
Suspension of obligations. Termination possible after 30 days.
14. Copyright
RCinéDrone retains all copyright. A usage license is granted to the client according to the terms defined in the agreement.
15. Transfer of Rights
Not permitted without written consent.
16. Severability
The remaining clauses shall remain valid.
17. Applicable Law
The laws of Quebec and Canada apply. Disputes shall be submitted to the courts of Quebec.
